These Terms of Service ("Terms") govern your use of the ACME Strength website located at this domain (the "Site") and the services offered by ACME Strength ("Gym," "we," "our," or "us"), a powerlifting and strength training facility located at 67 Main St, Severna Park, MD 21146. By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, do not use this Site.

1. Use of This Website

This Site is provided for informational purposes and to allow prospective and current members to learn about our programs and claim introductory offers. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site.

You must not use this Site to transmit any material that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

2. Introductory Offer and Membership

Information on this Site regarding free introductory offers, programs, and coaching hours is provided for general guidance and is subject to change without notice. The free technique assessment and first session offer is available to new members only, one per person, and may be modified or discontinued at any time.

A binding membership agreement is formed only when both parties have signed ACME Strength's membership enrollment forms, including any applicable membership agreement and required waivers. Submitting an assessment request via this Site or by phone does not create a contractual obligation on the part of either party.

3. Assumption of Risk, Waiver, and Physical Activity

Powerlifting and strength training are physical activities that involve inherent risks, including but not limited to musculoskeletal injury, acute injury from lifting equipment, and risks associated with maximal or near-maximal effort training. By participating in any training session or program at ACME Strength, members acknowledge that they are aware of and voluntarily assume these inherent risks.

All members will be required to review and sign ACME Strength's liability waiver and assumption of risk agreement prior to participating in any coaching session or using the open gym facility. The terms of those documents, as provided at enrollment, govern the parties' rights and obligations with respect to injury, liability, and related matters.

Members are responsible for disclosing any known medical conditions, injuries, or physical limitations to their coach prior to training. ACME Strength reserves the right to require a medical clearance before allowing a member to participate in certain program types.

4. Photo & Video Policy

By attending coaching sessions, open gym sessions, or other events at ACME Strength, members consent to photographs and videos taken during training, competition preparation activities, and other Gym events being used for promotional purposes, including but not limited to the Gym's website and social media channels.

If you prefer to opt out of photo and video use, please contact us at info@powerlifting.demo or speak with your coach. We will make reasonable efforts to honor opt-out requests.

5. Membership and Cancellation

Specific membership terms, program fees, billing cycles, and cancellation procedures are provided in the enrollment agreement given to members at the time of enrollment. This Site does not publish binding membership terms, as these may vary by program and are subject to change. Please contact us for current enrollment and pricing information.

6. Minors

Members under the age of 18 must have a parent or guardian sign all required enrollment forms, waivers, and agreements before participating in any training session. Parents and guardians are responsible for ensuring their minor's participation is appropriate given the minor's physical condition, maturity, and any medical considerations. Coaching programs for minors focus on foundational movement quality and age-appropriate loading; parents should discuss program details with the coaching staff.

7. Intellectual Property

All content on this Site, including text, graphics, logos, and images, is the property of ACME Strength or its content suppliers and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Site without prior written permission.

8. Disclaimer of Warranties

This Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. ACME Strength does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ACME Strength shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or reliance on any information provided here, even if ACME Strength has been advised of the possibility of such damages. Liability related to participation in training sessions or use of the facility is governed by the enrollment agreement and waiver signed at the time of enrollment.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Anne Arundel County, Maryland.
